The terms “website”, “this website”, “the website”, “portal” and “platform” used in this document refer to the website https://portalclienti.techem.ro. The design and content of the website are the exclusive property of Techem Energy Services S.R.L and are protected by intellectual property law.
Techem Energy Services S.R.L has its registered office in Bucharest, 8bis Ronda Street.
Before viewing this site, please read the following information carefully. They set out the terms and conditions governing your use of all materials comprising this website/portal. Accessing the website and using its applications implies your explicit or implicit acceptance of all the published Terms and Conditions, which are fully binding.
Techem Energy Services S.R.L reserves the right to amend the content of this agreement at any time. In such a case, Techem Energy Services S.R.L will notify users by updating the relevant information on the Portal. The user’s continued use of the website constitutes an affirmative acceptance of both these Terms and Conditions and any subsequent amendments made to this user agreement.
I. PURPOSE OF THIS DOCUMENT
This document sets out the terms and conditions governing access to and use of the Techem Customer Portal, as well as the responsibilities of users and Owners’ Associations in relation to the management of access and the use of the information available on the platform.
By creating an account, accessing or using the Customer Portal, the user confirms that they have read, understood and accepted the provisions of this document.
II. DESCRIPTION OF THE SERVICE
The Customer Portal is a software platform provided and managed by Techem Energy Services S.R.L., accessible online to authorised users. Techem grants users a limited, non-exclusive, non-transferable and revocable right to use the platform for the duration of an active account and subject to the terms of this document. The Customer Portal provides online access to information regarding:
• consumption readings recorded for residential units;
• documents made available by Techem;
• administrative information relating to properties;
• notifications and communications sent via the platform;
• other services and features available on the Portal.
The Customer Portal is an interface for accessing and viewing the information and documents available in Techem’s IT systems. The Portal does not constitute an independent system for calculating consumption, allocations or payment obligations, but displays the information and documents generated and made available through Techem’s systems.
III. SERVICE PACKAGES
The Customer Portal may be available in various service packages, each with distinct features.
The features available to users depend on the service package contracted by the Owners’ Association. Techem may offer both free and paid packages.
Owners’ and tenants’ access to certain features, including consumption data, may depend on the service package contracted by the Owners’ Association.
The terms and conditions, tariffs and billing arrangements applicable to paid packages are governed by the contracts, commercial offers or other contractual documents concluded between Techem and the Owners’ Association. Techem reserves the right to amend, supplement or reorganise the service packages and their associated features, subject to prior notification to the affected Associations.
IV. RIGHT TO USE THE PLATFORM
Techem grants users a limited, non-exclusive, non-transferable and revocable right to use the Customer Portal for the duration of an active account.
This right permits the use of the features available on the Portal solely for its intended purpose.
Users do not acquire any ownership rights over the application, source code, databases, algorithms, technical documentation or other components of the system.
The following is prohibited:
• copying the application;
• decompiling the software;
• reverse engineering;
• using the service for commercial purposes without Techem’s consent;
• distributing access to third parties;
• reselling the service.
To register as a member on the https://portalclienti.techem.ro portal, you are required to:
1) provide true, accurate and complete information about yourself, as requested in the website’s registration form;
2) maintain and update, where necessary, your registration details to ensure they remain true, accurate and complete. If you provide information that is untrue, inaccurate or incomplete, Techem Energy Services S.R.L. reserves the right to suspend or terminate your account and to refuse any current or future attempts to use the website.
Techem Energy Services S.R.L may, without further notice or formalities and without being required to explain its decision, suspend or terminate your access to the portal’s content or to any part of that content.
When you register as a member, you will be asked to choose a username and a password. You are responsible for keeping your password secure as a member of this site; any activity carried out under your username is entirely your responsibility
You must notify us immediately of any loss of your password or any signs of unauthorised activity under your username.
V. TYPES OF USERS
The Customer Portal may include the following categories of users:
1. Techem Employee
A user designated by Techem with full administrative rights. This role is available only to Techem employees.
They can create and manage the following accounts:
• Association Representatives;
• Standard Employees;
• Owners and Tenants.
2. Standard Employee
• A user appointed by the Association to manage one or more properties;
• This user is invited to the Portal to create an account by the Techem employee, based on the form completed and signed by the Owners’ Association;
• Cannot create other accounts for the Association;
• Invites and grants access to the Portal to tenants (owners/tenants);
• Has access to the consumption documents made available by Techem;
• Can use the features for which they have been granted rights and can reset access for owners and tenants in accordance with the Platform’s rules.
3. Employee with Limited Rights
• A user appointed by the Association;
• This type of user is invited to the Portal to create an account by a Techem employee on the basis of the form completed and signed by the Owners’ Association;
• Cannot create other accounts for the Association;
• Invites and grants access to the Portal to tenants (owners/tenants);
• May use the features for which they have been granted rights and may reset access for owners and tenants in accordance with the Platform’s rules.
4. Owner / Tenant
Accounts can be created:
• by invitation sent by users authorised by the Association;
• by invitation sent by Techem, but only upon written request from the Association, submitted via the form completed and signed by the Owners’ Association;
• by requesting the activation code required to register the flat from the Association;
• Owners and tenants may not create accounts for other users;
VI. GRANTING AND MANAGING ACCESS
Access for users associated with a Homeowners’ Association is granted on the basis of the information and requests received from the Association.
Techem is entitled to assume that any person designated by the Association to access the Portal is legally authorised to use the information available.
The administrators appointed by the Association are responsible for managing users and access rights in accordance with the duties assigned to them.
VII. THE ASSOCIATION’S RESPONSIBILITY REGARDING USERS
The Owners’ Association, through its representatives and designated users who have been granted administrative rights on the Customer Portal, is solely responsible for:
• designating the users who are to have access to the Portal;
• the accuracy of the data provided for the creation of accounts;
• updating the list of authorised persons;
• requesting changes to access rights;
• requesting the suspension or deletion of access.
The Association guarantees that the designated persons are authorised to use the information available on the Portal.
VIII. OBLIGATION TO UPDATE ACCESS RIGHTS
The Owners’ Association is obliged to request, without delay, the amendment, suspension or revocation of access for any person who:
• is no longer the chair of the association;
• is no longer a director;
• no longer represents the association;
• no longer works for the management company;
• is no longer the owner of the property;
• is no longer a tenant;
• is no longer authorised to use the Portal.
This obligation rests solely with the Association.
The management of access, modification and removal of tenants may also be carried out by the Owners’ Association via the Portal.
IX. CHANGES IN OWNERSHIP AND TENANTS
The Association acknowledges and accepts that Techem cannot verify and cannot be constantly aware of:
• changes in ownership;
• the sale of flats;
• changes in tenants;
• the termination of tenancy agreements;
• changes in designated representatives.
Updating the access rights for these individuals is the sole responsibility of the Association.
X. DISCLAIMER REGARDING ACCESS MANAGEMENT
Until an express request to amend or withdraw access is received, Techem is entitled to assume that all existing accounts are being used by authorised persons.
Techem shall not be liable for:
• maintaining access for persons who have lost their status as authorised users;
• the Association’s failure to update user details;
• the use of information by persons designated by the Association;
• granting access on the basis of information provided by the Association;
• any losses resulting from the failure to update access rights.
Full responsibility for user management lies with the Association.
XI. ACCOUNT CONFIDENTIALITY
Each user is responsible for:
• keeping their password confidential;
• the security of their login details;
• all activities carried out via their account.
Login details must not be disclosed to third parties.
XII. OWNERSHIP OF DATA AND THE GDPR
Data entered into the Portal remains the property of the individuals or organisations that provided it.
With regard to personal data processed via the Customer Portal:
• The Owners’ Association acts as the Data Controller;
• Techem acts as the Data Processor.
The Association is responsible for ensuring the lawfulness of the collection and entry of data into the Portal.
Techem processes the data solely for the purpose of providing the contracted services and does not use the data of owners and tenants for its own marketing purposes.
Details regarding data processing are set out in the Privacy Policy and in the Data Processing Agreement, where applicable.
XIII. PLATFORM AVAILABILITY
Techem shall use reasonable endeavours to ensure the continuous operation of the Portal.
Techem may carry out the following activities:
• maintenance;
• updates;
• troubleshooting;
• system security.
Techem does not guarantee the uninterrupted operation of the Portal and accepts no liability for interruptions caused by technical reasons, cyber-attacks, force majeure or services provided by third parties.
In the event of maintenance, updates, recalculations, repairs or synchronisation delays between Techem’s systems, certain information or documents may be updated, replaced or republished without individual notification.
XIV. NOTIFICATIONS AND COMMUNICATIONS
The Portal may send notifications via:
• email;
• SMS;
• push notifications;
• in-app notifications.
These notifications are for information purposes only.
Notifications sent via the Portal do not replace the legal obligations regarding communication, convening, display or notification as provided for by the legislation applicable to owners’ associations.
XV. Management and Ownership of User Data
1. Customers shall enter their own data (or that of their customers) into the platform:
• Ownership of data: All data, documents and information entered or uploaded to the Portal by the User remain the exclusive property of the User or of the persons on whose behalf the User processes them.
• Right to process: By using the Portal, the User grants Techem Energy Services the right to host, store, copy and process the data entered solely for the purpose of providing and operating the services available on the Portal.
• Data export: The User is responsible for exporting and downloading any data they wish to retain before requesting the deletion of the Association’s account or before deleting their own account.
2. Tenants’ confidentiality clause: Techem Energy Services S.R.L. does not use the personal data of landlords and tenants for its own marketing purposes and does not disclose such data to third parties for such purposes without a legal basis or the data subject’s consent, as applicable.
XVI. DATA EXPORT AND DELETION
In the event of the termination of the contractual relationship between the Association and Techem, the Association is obliged to download the data from the portal before requesting the deletion of the account or before deleting the account itself.
Once the applicable statutory and contractual retention periods have expired, the data may be deleted or anonymised.
XVII. AMENDMENTS TO THE PLATFORM AND THIS DOCUMENT
Techem reserves the right to amend the Portal’s functionalities and the provisions of this document where necessary for operational, technical, legal or security reasons.
The updated version will be published on the Portal and will take effect from the date of publication.
XVIII. GOVERNING LAW
This document is governed by Romanian law.
Any dispute arising from the use of the Customer Portal shall be settled amicably; where this is not possible, the matter shall be referred to the competent courts in Romania.
